1. Who we are, and what these terms cover
These Terms & Conditions govern your use of the website https://secondgatewp.com, the free SecondGate WordPress plugin as distributed through the WordPress.org plugin directory, and any paid features, subscriptions, or products offered by SecondGate (“we,” “us,” “our”), a business based in the United Kingdom. By using this website, installing the plugin, or purchasing anything from us, you agree to these terms. If you don’t agree, please don’t use the site, the plugin, or purchase anything from us.
2. The free plugin and the GPL licence
The core SecondGate plugin, as distributed through WordPress.org, is licensed under the GNU General Public License (GPL), version 2 or later. This means, among other things, that you have the right to use, modify, and redistribute the plugin’s code freely, including commercially, subject to the terms of the GPL itself.
We do not restrict this. If you obtain the plugin through WordPress.org, its distribution and your rights over that code are governed by the GPL, not by these Terms & Conditions. These terms primarily govern your use of this website, the purchase of any paid features or subscriptions, and any support or services we provide directly.
3. Paid features and subscriptions
Certain advanced features (“Pro” features) are made available under a paid subscription, currently priced at £19.99 per year unless otherwise stated at the time of purchase. Pricing is subject to change; any change will not affect a subscription you have already paid for during its current billing period.
What you’re paying for: a subscription unlocks access to Pro features via a licence key, along with ongoing updates and, where offered, support, for the duration of your subscription. Because the underlying plugin code remains GPL-licensed, purchasing a subscription does not restrict your rights over the code itself under the GPL, you are paying for the licence key mechanism, ongoing updates, and support, not for a licence to the code, which the GPL already grants you.
Free testing period: the first 100 testers, as determined by us at our discretion, will be granted full Pro access at no charge for a period we will communicate at the time. We reserve the right to end, extend, or modify this offer at any time before it is claimed.
Auto-renewal: subscriptions renew automatically at the end of each billing period unless cancelled beforehand. You can cancel at any time through your account or by contacting us; cancellation takes effect at the end of the current billing period, and you retain access until then.
4. Payment
Payments are processed securely through Stripe and PayPal. We do not store your full payment card details. By subscribing, you authorise us (via our payment processor) to charge your chosen payment method on a recurring basis until you cancel.
5. Refunds
We offer a 14-day money-back guarantee on new Pro subscriptions, no questions asked, if you request a refund within 14 days of your initial purchase. Refund requests after this period are considered at our discretion, taking into account the circumstances of the request. To request a refund, contact us at info@secondgatewp.com. Refunds for renewal payments (as opposed to initial purchases) are not automatically guaranteed but may be considered on a case-by-case basis.
6. Acceptable use
You agree not to:
- Use the website, plugin, or any paid features for any unlawful purpose, or in a way that infringes the rights of others
- Attempt to circumvent, disable, or interfere with the licensing mechanism for Pro features other than through legitimate means (a valid subscription, or your rights under the GPL for the underlying code)
- Use the site or plugin to attack, disrupt, or gain unauthorised access to any system, including our own
- Misrepresent your identity or affiliation with us, including falsely claiming official endorsement or partnership
- Resell or redistribute Pro-specific licence keys or subscription access without our written permission (this does not affect your GPL rights over the underlying code itself)
We reserve the right to suspend or terminate access to Pro features, without refund, for a serious or repeated breach of this section.
7. Intellectual property
The SecondGate name, logo, and branding are our trademarks and are not covered by the GPL licence applied to the code. You may not use our name, logo, or branding to imply endorsement, partnership, or affiliation without our written permission, including if you redistribute or modify the underlying GPL code, you may not represent your modified version as being officially from SecondGate.
Content on this website, text, design, images, and similar, excluding the plugin’s own GPL-licensed source code, is owned by us or licensed to us, and may not be reproduced without permission, except as permitted by law (such as fair dealing/fair use).
8. No guarantee of security
This is important, and we want to be direct about it: no security product, including this one, can guarantee that your website will never be compromised. SecondGate is designed to significantly reduce risk and catch a wide range of real, common attack patterns, but security is never absolute. New attack techniques emerge constantly, and a determined, sufficiently resourced attacker may succeed regardless of what protective software is in place.
By using SecondGate, whether the free or Pro tier, you acknowledge and accept that:
- We make no warranty, express or implied, that the plugin will prevent all unauthorised access, data breaches, malware, or other security incidents
- You remain responsible for your own site’s overall security posture, including keeping WordPress core, themes, and other plugins up to date, using strong credentials, and maintaining your own backups
- We are not liable for any loss, damage, or harm arising from a security incident on your site, whether or not SecondGate was installed or active at the time, except where such liability cannot lawfully be excluded
9. Disclaimers and limitation of liability
The website, plugin, and any paid features are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business, or goodwill, arising from your use of, or inability to use, the website, plugin, or any paid features
- Our total liability to you for any claim arising from these terms, or your use of any paid features, will not exceed the amount you paid us in the 12 months preceding the claim
- Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for fraud, or for death or personal injury caused by our negligence
10. Service availability
We aim to keep this website and any services related to Pro subscriptions (licence validation, updates, support) available and functional, but we do not guarantee uninterrupted availability. We may suspend access for maintenance, updates, or reasons beyond our reasonable control, and will aim to minimise disruption where possible.
11. Changes to Pro features
We may add, modify, or discontinue individual Pro features over time as the product develops. We will make reasonable efforts to maintain the overall value of a Pro subscription, but do not guarantee that any specific individual feature will remain available indefinitely.
12. Termination
You may stop using the website or plugin, or cancel your subscription, at any time. We may suspend or terminate your access to Pro features if you materially breach these terms, including the acceptable use provisions in Section 6, though we will generally attempt to notify you and give you an opportunity to resolve the issue first, except in cases of serious or repeated breach.
Termination of a Pro subscription does not affect your rights under the GPL over the underlying plugin code, which remain in place regardless.
13. Changes to these terms
We may update these terms from time to time to reflect changes in our services, pricing, or legal requirements. The “last updated” date at the top will always reflect the most current version. Continued use of the website, plugin, or Pro features after a change constitutes acceptance of the updated terms. Material changes affecting existing subscribers will be communicated by email where practical.
14. Governing law
These terms are governed by the laws of England and Wales. Any dispute arising from them will be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to your right, as a consumer, to bring proceedings in your own country of residence where applicable law provides for that.
15. Severability
If any provision of these terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
